Welcome to the Terms of Service (“ToS”) for STEAM Engine Global Pty Ltd, operating as IT Girls Rock (“Company”). By accessing or using the services provided by STEAM Engine Global Pty Ltd, including participation in Community Membership as well as the Tech Founder TransformHer and Tech Confidence & Freedom TransformHer programs (“Programs”), you agree to comply with and be bound by these Terms of Service.
2. Program Enrolment and Participation
- Eligibility: The Programs are available to women entrepreneurs and tech founders who meet the program criteria. By enrolling, you confirm that you meet these criteria.
- Enrolment Confirmation: Your enrolment is confirmed upon receipt of payment and acceptance into the program.
- Duration: The Programs run for a duration of six months from the enrolment date, and all sessions must be completed within this timeframe.
- Active Participation: You agree to actively participate in all scheduled sessions, workshops, and activities included in the Program. Missed sessions cannot be rolled over or rescheduled unless otherwise agreed upon by the Company.
3. Payment Terms
- Payment Options: Participants can choose from the available payment options provided upon enrolment (e.g., full payment, deposit plus instalments). All prices are listed in USD unless otherwise specified.
- Non-Refundable: All payments made are non-refundable, except where required by law. By agreeing to these ToS, you acknowledge your commitment to the full financial responsibility of the Program.
- Late Payments: If you are on a payment plan, you must make payments by the agreed-upon due dates. Failure to make timely payments may result in suspension or termination of your access to the Program until payments are up to date.
4. User Responsibilities and Conduct
- Respectful Participation: You agree to engage in a respectful and professional manner during all Program activities, sessions, and communications. Disruptive or inappropriate behaviour may result in immediate termination without a refund.
- Confidentiality: You agree to maintain the confidentiality of any personal or sensitive information shared by other participants, coaches, or the Company. This includes not sharing login details, program materials, or private discussions with anyone outside the Program.
- No Misuse of Content: You are prohibited from using Program content for any illegal, harmful, or unauthorised purposes.
5. Content Ownership and Intellectual Property
- Program Materials: All materials provided during the Program, including written content, videos, audio recordings, presentations, and templates, are the intellectual property of STEAM Engine Global Pty Ltd.
- Limited License: You are granted a non-transferable, revocable license to access and use Program materials for your personal development only. You may not reproduce, distribute, share, modify, or create derivative works from any Program content without explicit written permission from the Company.
6. Limitation of Liability
- No Guarantees: While the Company strives to provide high-quality coaching and support, it does not guarantee any specific outcomes, success, or results from participation in the Programs. Success depends on your individual efforts and application of the material.
- Assumption of Risk: You acknowledge that you are participating in the Programs voluntarily and assume all risks associated with your participation.
- Limited Liability: To the fullest extent permitted by law, STEAM Engine Global Pty Ltd is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your participation in the Programs.
7. Privacy and Data Protection
Privacy Policy: The Company respects your privacy and will handle your personal information in accordance with our Privacy Policy, which can be found on our website. By participating in the Programs, you consent to the collection, use, and processing of your personal information as described in the Privacy Policy.
8. Termination and Suspension
- Grounds for Termination: The Company reserves the right to suspend or terminate your access to the Programs without notice or refund if you breach these ToS, engage in disruptive behaviour, or fail to make required payments.
- Termination by Participant: You may choose to terminate your participation at any time; however, no refunds will be issued, and you remain responsible for any outstanding payments.
9. Dispute Resolution and Governing Law
- Governing Law: These ToS are governed by and construed in accordance with the laws of Australia.
- Dispute Resolution: Any disputes arising out of or relating to these ToS or the Programs will be resolved through binding arbitration in [State, Australia]. Each party will bear its own costs in the arbitration process.
